Cape Town [Salt River] on 25 February 2010

Seventeen people were injured when a Toyota Venture overturned at "hospital bend" in the direction of Newlands.

One adult and sixteen children sustained minor to moderate injuries and were taken to various surrounding hospitals for further treatment.

The cause of the accident is unknown but it is alleged that the driver lost control of the vehicle causing it to overturn. ER24, Life ASU, Metro EMS, Fire Department and SAPS were all in attendance and assisted with the patients.

  1. An investigation is likely to determine that there were several contributing factors to a truck accident. All drivers have a duty to exercise reasonable care in the operation of their motor vehicle. This duty makes drivers accountable for acts which they knew would likely result in injury to person or property and for acts which they should have known would likely result in injury to person or property. A finding of negligence will create liability for any injuries sustained as a result of that negligence.Courts will look to various factors in determining a driver´s negligence. In all such cases, it´s important to have a knowledgeable attorney who will explain all possible avenues for recovery.
